PENAL CODE

section 282

Rape is committed when sexual intercourse occurs:
 

  • Againt her will.

  • Without her consent.

  • When consent has been obtained through fear of hurt or death.

  • when consent was obtained under deceit.

  • with or without consent when she is under 14 years of age, or of unsound mind.

CRIMINAL CODE

section 357

Any person who has unlawful carnal knowledge of a woman or girl witout her consent or with her consent IF:

  • The consent is obtained by force, threat, intimidation, or by fear of harm.

  • By means of false & fradulent representation as to the nature of the act, or by impersonating her husband.

CHILD RIGHTS ACT

The Child Rights Act protects the girl child under the age of 18, and prohibits the exploitation of children in any form, including but not limited to:

  • Buying, selling, hiring, or dealing with children for the purpose of hawking or begging for alms or prostitution.​

  • Unlawful sexual intercourse with a child.

  • Child betrothal.

VIOLENCE AGAINST PERSONS PROHIBITION (VAPP) ACT

In addition to the rights guaranteed under the constitution, the VAPP Act prohibits:

  • Domestic abuse, incl. spousal battery.

  • Harassment - engaging in a pattern of conduct that induces fear or harm or impairs the dignity of a person.

  • Harmful traditional practices

    • harmful widowhood practices.

    • denial of inheritance/succession rights.

    • female genital mutilation.

    • forced marriage.

    • forced isolation.

  • Forced ejection from home.

  • Abandonment of spouses, children, and other dependents without sustenance.
