The penal code is applicable in the Northern States of Nigeria
Penal Code
section 282:
Rape is committed when sexual intercourse occurs:

Againt her will.

Without her consent.
-
When consent has been obtained through fear of hurt or death.

when consent was obtained under deceit.
-
with or without consent when she is under 14 years of age, or of unsound mind.
CRIMINAL CODE
The criminal code is applicable in the Southern States of Nigeria
Criminal Code
section 357:
Any person who has unlawful carnal knowledge of a woman or girl witout her consent or with her consent IF:
-
The consent is obtained by force, threat, intimidation, or by fear of harm.

By means of false & fradulent representation as to the nature of the act, or by impersonating her husband.
